The Supreme Court of India has ruled that a stay order granted in civil and criminal cases does not automatically lapse after six months and will remain in operation until the matter is decided, unless it is specifically time-bound. The ruling, which overturns a 2018 decision, states that there cannot be an automatic vacation of stay orders granted by a lower court or high court in civil and criminal cases after six months. The Supreme Court also stated that constitutional courts should refrain from fixing timelines for disposal of cases, and this can only be done in exceptional circumstances.
