The lawsuit claimed that the state's child welfare agency should have removed Adrian from an abusive home before his death. The Kansas Department for Children and Families received numerous reports of abuse before his death, but did not intervene. Governor Laura Kelly and lawmakers approved the settlement during a private meeting, stating that it was necessary to avoid lengthy litigation and focus on improving the child welfare system.
