18-year-old Payton Gendron's lawyers seek to exempt him from the death penalty in a federal case, arguing his brain was still developing at the time of the Buffalo supermarket massacre.

Payton Gendron's lawyers are seeking to exempt him from the death penalty in a separate federal case, arguing his brain was still developing at the time of the Buffalo supermarket massacre. Gendron, who was 18 when he killed 10 Black people in a racially-motivated attack, is already serving a whole life sentence for state charges. His legal team cites scientific advancements in understanding brain development, which suggest the brain matures beyond the age of 18. They argue that people under 21 should not be punished like adults as they are still in the throes of cognitive development.
