The US Department of Justice is seeking the death penalty in the case of a white supremacist who killed 10 Black people in a New York supermarket.

Federal prosecutors on Friday announced their intention to seek the death penalty against Payton Gendron, the man who killed 10 Black people in a mass shooting at a Buffalo supermarket in 2022. The shooter had previously been sentenced to life in prison without parole after admitting his guilt in a New York state court. However, under a deal that he was promised, the defense would plead guilty to federal hate crime charges if the death penalty was taken off the table. Since New York state does not have the death penalty, the decision to seek the death penalty came through federal charges instead.
