75% of sexual harassment lawyers in Australia use non-disclosure agreements (NDAs) in out-of-court settlements despite guidelines discouraging their use, according to research. The misuse of NDAs prevents victims from sharing their experiences and potentially halts the healing process. Although 30% of applicant practitioners and 50% of respondent practitioners have never advised clients about the option of not using an NDA, guidelines released by the Respect@Work Council in December 2022 suggest that confidentiality clauses should not be seen as standard terms.
