Survey finds NDAs and mandatory arbitration clauses prevalent, raising concerns over silencing workplace misconduct.

A survey by Penn State University's Mark Gough reveals that 45% of US employees are required to sign nondisclosure agreements (NDAs) and 39% are subject to mandatory arbitration. The study, involving 947 job seekers, highlights concerns over the use of these agreements to silence victims of workplace misconduct. It also found racial disparities, with 48% of Black respondents required to sign away their right to class action lawsuits compared to 39% of White respondents. Employees suing in court tend to receive higher payouts than those in arbitration.
