The U.S. Department of Justice has filed a lawsuit against the state of Tennessee, alleging that the state's aggravated prostitution statute, which targets HIV-positive individuals, violates the Americans with Disabilities Act (ADA). The DOJ's investigation found that the statute treats HIV-positive people differently, subjecting them to harsher criminal penalties for engaging in prostitution. Tennessee is the only state in the U.S. that imposes lifetime registration as a "violent sex offender" if convicted of engaging in sex work while living with HIV.
