The decision reversed a lower court ruling that had dismissed the majority of the case against Benjamin, who allegedly funneled a $50,000 state grant to a developer in exchange for campaign contributions. The appeals court stated that a jury could infer from the alleged facts that Benjamin promised to allocate state funds to a non-profit organization controlled by a real estate developer in return for campaign contributions.
