9th Circuit Court reverses dismissal of hospital lawsuit against Oregon Health Authority over mental illness care.
The U.S. Court of Appeals for the Ninth Circuit ruled that a lawsuit filed by four hospital systems against Oregon Health Authority (OHA) over the state's failure to adequately care for individuals with severe mental illness was wrongfully dismissed. The case will return to the United States District Court for the District of Oregon for further legal proceedings. The hospital systems, Legacy Health, PeaceHealth, Providence Health & Services, and St. Charles Health System, accused OHA of neglecting its duty to care for civilly committed patients, who often end up in emergency rooms without receiving adequate care.
