Montana's Supreme Court upheld a lower court ruling that three 2021 laws related to colleges and universities were unconstitutional, including a ban on transgender athletes playing on women's sports teams. The court found that the state legislature overstepped by creating policies for university athletics, which should be the role of the Board of Regents. The state did not defend two of the bills, and the court agreed that HB 112 did not pass muster.
