Two students sue US Dept of Education over McNair Program's race requirements, arguing unconstitutionality and equal protection violation.

Two students from UND and UW-Madison, backed by conservative legal center Wisconsin Institute for Law & Liberty, filed a lawsuit against the US Dept of Education & Sec. Miguel Cardona, arguing that the McNair Program's race requirements are unconstitutional and unfairly exclude students like themselves. The program, which provides $60m annually to around 6,000 students, prioritizes Black, Hispanic, Native American, and Native Hawaiian students, while the lawsuit claims this preference violates the Constitution's equal protection guarantee.
