HHS finalized a rule to establish disincentives for healthcare providers committing information blocking, exercising its authority under the 21st Century Cures Act. The rule enforces disincentives for providers who interfere with, prevent, or materially discourage access, exchange, or use of electronic health information, except as required by law or covered by a regulatory exception. HHS has established financial disincentives for providers found to have committed information blocking by the HHS Office of Inspector General and referred to the Centers for Medicare & Medicaid Services.
