The NCAA has sued DraftKings, alleging trademark infringement over the sportsbook’s use of terms like March Madness, Final Four, and Elite Eight during the NCAA basketball tournaments.
Filed in federal court in Indiana, the lawsuit seeks an emergency injunction to stop DraftKings from using the terms, claiming it violates the NCAA’s policy of remaining unaffiliated with sports betting and undermines its brand.
DraftKings argues its use is protected under the First Amendment as fair, descriptive use to identify tournaments, similar to referencing the NIT, and denies any trademark violation.
The NCAA requested a Monday briefing, and as of Saturday, the DraftKings app still displayed the contested terms.
