India's Chief Justice recuses himself from case challenging law altering election commissioner appointments, citing conflict of interest.
Chief Justice of India Surya Kant has recused himself from hearing petitions challenging the 2023 law that removed the CJI from the panel appointing the Chief Election Commissioner and other election commissioners.
He cited a potential conflict of interest, noting that the case should be heard by a bench where no member is next in line to become CJI, to avoid even the appearance of bias.
The law replaced a Supreme Court-mandated committee—including the CJI—with one comprising the Prime Minister, a Union Minister nominated by the PM, and the Leader of the Opposition.
The case, which questions the law’s impact on the Election Commission’s independence, will be heard on April 7 by a newly constituted bench.
