The Nebraska Supreme Court ruled that Mark Martinez, the Democratic candidate for Douglas County sheriff, can remain on the ballot, rejecting claims he lacked a valid law enforcement certification.
The court, led by Justice William Cassel, determined that state law does not require an "active" certificate, only that candidates possess one, allowing Martinez—former Omaha police officer and U.S. Marshal—to stay in the race.
As the sole Democratic candidate, Martinez will advance to the general election without a primary.
Incumbent Republican Sheriff Aaron Hanson will also face him in November.
The decision resolves a dispute sparked by the Douglas County Election Commissioner’s initial disqualification, which the court called inconsistent with the law’s plain language.
