Ireland’s WRC says Gardaí must pay €15,000 to a police officer wrongfully suspended for three years with no charges filed.
The Workplace Relations Commission has recommended An Garda Síochána pay €15,000 in compensation to a serving officer after a three-year suspension that began in 2019 over a traffic incident.
Despite the Director of Public Prosecutions deciding in July 2020 not to pursue any charges—information not shared with the officer—the suspension continued until December 2022.
No formal disciplinary proceedings were ever initiated, and the Garda, who had a clean record and over 18 years of service, only returned to duty after threatening legal action.
The WRC found the agency failed to follow its own procedures, including timely notifications, monthly meetings, and vacancy alerts, and acknowledged the suspension caused undue distress due to poor communication and lack of review.
The compensation recommendation stems from these systemic failures, despite correct payment of suspension allowances.
