Irish court denies extradition immunity for two fugitives, upholding UK request over 1975 Northern Ireland killings.
An Irish court has ruled that fugitives who have lived openly for decades in Ireland do not have immunity from extradition, upholding the UK’s request to extradite John Edward McNicholl, 73, and Seamus Christopher O’Kane, 74, over a 1975 INLA murder and attempted murder in Northern Ireland.
Both men escaped from Maze Prison in 1976 and have since lived in Ireland, but the court said their integration into society does not override Ireland’s extradition obligations under the Trade and Cooperation Agreement.
Despite delays and administrative issues, the court found no constitutional or human rights violations, and dismissed health and time-related arguments.
A stay has been granted to allow a Supreme Court appeal.
