A 72-year-old Wellsville man’s attempt to overturn his 2023 rape conviction and life sentence was denied by a judge.
A Wellsville man, Spencer Kidder, 72, has had his bid to vacate his 2023 rape conviction and life sentence denied by Judge Mary Bickerton.
His request, based on claims including ineffective counsel and newly discovered evidence, was rejected after the court found he failed to meet his burden of proof.
The judge noted Kidder had been informed of his right to appeal and had already lost prior appeals at the Seventh District Court of Appeals and Ohio Supreme Court.
The original jury convicted him on multiple counts related to alleged abuse of a child between 2014 and 2020, resulting in a life sentence without parole for two rape charges and additional prison time for others.
The conviction and sentence were upheld after multiple reviews.
