He argued the restaurant should have warned customers about the heat, but a federal judge dismissed the case, stating spiciness is expected in Mexican cuisine and no legal duty to warn exists.
The man, who had no prior experience with spicy food, did not seek medical care and continued his trip, including attending the US Open.
Though he lost the lawsuit, he said he hopes the restaurant will label its salsas to prevent future incidents.
