Costco sued over refunds due to invalidated Trump tariffs; plaintiffs say it must return price increases to consumers.
A proposed nationwide class action lawsuit filed in Illinois federal court alleges Costco must refund customers for higher prices paid due to Trump-era tariffs invalidated by the U.S. Supreme Court on February 20.
The suit argues that if Costco receives government refunds for duties paid under the now-unconstitutional International Emergency Economic Powers Act, it should return those funds to consumers who bore the cost.
The case claims Costco would otherwise profit twice—once from the refund and again from retaining higher prices.
While Costco has not commented, CEO Ron Vachris said any refunds would likely lower future prices, but the lawsuit contends this does not compensate past shoppers.
A similar suit has been filed against FedEx.
