A 39-year-old man with 39 prior convictions, convicted in 2024 of kidnapping, sexual assault, and assault causing harm after attacking a Limerick woman in 2020, is appealing his seven-year sentence with six months suspended.
His lawyers argue a 40-minute 999 emergency call made by the victim should not have been played in full, claiming it was unnecessarily lengthy, irrelevant, and prejudicial.
They say it added nothing beyond her testimony and that the judge erred in not instructing the jury on untested forensic evidence.
Prosecutors maintain the call was vital to showing the victim’s trauma and the urgency of her situation.
The Court of Appeal has reserved judgment.
