A Georgia judge has denied Jose Ibarra’s request for a new trial in the 2024 murder of nursing student Laken Riley, ruling the state’s evidence was overwhelming and that Ibarra’s constitutional rights were not violated.
Ibarra, a Venezuelan man who entered the U.S. illegally in 2022, was convicted in November 2024 and sentenced to life in prison after waiving his right to a jury trial.
His attorneys had challenged the denial of a delay to review DNA evidence using TrueAllele software and the seizure of two cellphones not listed on the original search warrant, but the judge found exigent circumstances justified the seizures and deemed the defense’s arguments unpersuasive.
Ibarra has 30 days to appeal.
