Former judge Gerard O’Brien, 61, is appealing his 2023 conviction for attempted anal rape and eight counts of sexual assault involving six young men he allegedly abused as a high school teacher over 30 years ago.
His legal team argues the trial judge’s jury instructions were biased and confusing, unfairly undermining O’Brien’s testimony and creating undue pressure by mentioning deliberations could continue on Christmas Eve.
They also claim errors in denying separate trials and improperly referencing O’Brien’s legal expertise during jury deliberations.
O’Brien, who resigned in 2015 and was sentenced to four years in prison in June 2024, maintains his innocence.
The State asserts the trial was fair, and the appeal remains ongoing.
