Cleric Walter Magaya seeks constitutional review of his rape trial, claiming rights violations and prosecutorial misconduct.
Cleric Walter Magaya has sought referral of his rape case to Zimbabwe’s Constitutional Court, arguing the prosecution violates his constitutional rights to a fair trial, liberty, and equality.
Facing six counts of rape involving three complainants between 2013 and 2018, Magaya denies the charges and claims some complainants withdrew allegations, which he says should halt the trial.
He alleges prosecutorial misconduct, including unauthorized changes to witness statements, failure to disclose the original arrest statement, and DNA evidence collected without his legal counsel present.
The National Prosecuting Authority disputes the claims, stating the withdrawal letter was still under administrative review and DNA results remain pending.
The case is pending, with a hearing set for Thursday.
