Zimbabwean court grants $1,000 bail to religious leader convicted of rape, citing flawed trial and lack of consent evidence.
A Zimbabwean High Court has granted $1,000 bail to religious leader Ishmael Chokurongerwa, known as Madzibaba Ishmael, pending appeal in his rape conviction, citing serious legal flaws in the trial.
Justice Neville Wamambo found issues with DNA evidence handling, inconsistencies in the complainant’s age, and the trial court’s flawed reasoning in concluding rape occurred due to lack of consent testimony.
The complainant exonerated Chokurongerwa and a birth certificate suggested she was over the age of consent, though its authenticity was disputed.
The court noted no direct evidence of non-consensual sex and deemed the 20-year sentence excessively harsh.
Chokurongerwa must reside in Harare, report to police three times weekly, and appear for appeals.
