The Kerala High Court dismissed a petition challenging the state government’s use of bulk WhatsApp messages to employees and citizens ahead of the 2026 assembly elections.
Ruling on March 10, 2026, Justice Bechu Kurian Thomas stated the messages—focused on benefits like dearness and house rent allowances—were legitimate government communications, not political campaigning.
The court found no evidence of privacy violations or misuse of personal data from the SPARK portal, concluding the messages served public welfare and did not breach the Digital Personal Data Protection Act or Article 21.
The decision allows the state to continue such messaging for informational purposes.
