A Franklin County judge has temporarily blocked Ohio’s plan to use over $1 billion in unclaimed funds to finance a new Browns stadium in Brook Park, citing constitutional concerns over government seizure of private property without due process.
The injunction, issued by magistrate Jennifer Hunt, halts the project while a class-action lawsuit proceeds.
The suit, filed by former Ohio Attorney General Marc Dann and former state Rep. Jeffrey Crossman on behalf of residents, challenges a budget provision that redirected unclaimed funds to a new grant fund for sports and cultural facilities, with $600 million earmarked for the Browns.
Ohio Attorney General Dave Yost previously opposed the plan and urged a veto, but his office now says the funding approach is legally valid.
The case remains pending.
