A federal judge in Oregon, Michael Simon, has issued a preliminary injunction limiting federal agents' use of tear gas and other crowd-control weapons during protests outside the Portland ICE building, ruling that widespread deployment against peaceful demonstrators violates First Amendment rights.
The order, stemming from a lawsuit by the ACLU of Oregon on behalf of protesters and journalists, prohibits the use of such force unless there is an imminent threat of physical harm and bans indiscriminate spraying or targeting the head, neck, or torso.
The injunction applies to all peaceful protesters and reporters at the site and remains in effect as the case continues.
