An NSW court ruled against releasing a child’s interview transcript, citing harm to her welfare and ongoing investigation risks.
An 11-year-old in Wollongong was interviewed by the Illawarra Child Abuse Squad in December 2024, prompting her father to request access to the interview transcript and police documents via freedom of information.
His request was denied and upheld on appeal by NSW Information Commissioner Dr. Linda Kirk, who ruled that releasing the sensitive material—containing private details about a minor—would harm the child’s welfare, risk ongoing investigations, and expose third-party information.
Though the father claimed the child was traumatized and needed the documents for medical care, the tribunal concluded disclosure was not in the child’s best interests.
The final decision was issued on March 9, 2026.
