Nintendo has sued the U.S. government seeking refunds with interest for tariffs paid on Switch 2 consoles and accessories, following a Supreme Court ruling that invalidated the legal basis for Trump-era tariffs imposed under the International Emergency Economic Powers Act.
The company, which delayed pre-orders and raised accessory prices due to the tariffs, argues the duties caused financial harm and were unlawfully collected.
The lawsuit, filed in the U.S. Court of International Trade, names multiple federal agencies and officials as defendants and joins over 1,000 other companies challenging the tariffs.
U.S. Customs and Border Protection expects a refund system to launch in 45 days.
