The Maryland Senate has approved the Youth Charging Reform Act, which would give judges discretion to decide whether to charge 16- and 17-year-olds as adults for five specific offenses: firearm sales, firearm use in drug crimes, firearm use with prior drug felony, first-degree assault, and carrying a handgun.
The bill, sponsored by Sen. Will Smith, removes automatic adult charging for these crimes, aiming to reduce racial disparities, improve rehabilitation, and save costs.
It excludes life imprisonment, second-degree murder, and repeat offenders.
Republican amendments to expand automatic charging were defeated.
The bill now moves to the House of Delegates.
