The Delhi High Court has dismissed a 2025 writ petition by a former DANICS officer challenging a 2016 disciplinary penalty for allowing a ₹3.26 crore refund in a land acquisition case after his transfer, ruling he lacked legal authority to reverse the acquisition once land vested with the government.
The court upheld a penalty including a three-year pay scale reduction, halted promotions, delayed increments, and seniority loss, finding no procedural flaws or violations of natural justice.
It rejected the officer’s claim of delay, noting the petition was filed nearly four years after the Central Administrative Tribunal’s decision without justification, and dismissed allegations of discrimination, stating his successor had only implemented the order.
