A draft law named Jax’s Law, set for publication by the end of March 2026, aims to extend legal recognition and penalties to unborn babies of at least 23 weeks’ gestation who die in crashes caused by dangerous driving.
Proposed by Fine Gael TDs Barry Ward and Emer Currie, the bill would allow offenders to face up to 10 years in prison, the same penalty as for dangerous driving causing death.
The legislation is named after Jax, an unborn child who died in a 2024 crash in County Wexford, and has garnered cross-party support.
His mother, Saoirse Aylward, and Colleen Langan, whose aunt and unborn niece died in a 2010 crash, advocate for the bill, emphasizing that current laws do not officially recognize or record deaths of unborn children in traffic accidents, despite their lives being lost.
