The court emphasized that divorce decisions cannot be made ex parte and must uphold due process, requiring both parties to present evidence.
The case, involving a husband's claim of emotional distress from messages about relocation and criticism of in-laws, has been sent back for a fresh hearing with the wife now able to defend herself.
The court also encouraged mediation.
