The man, who mistakenly arrived at her property to buy a car part, was threatened with a gun, called a racial slur, and shot at twice, causing a crash.
Durgin told a 911 dispatcher she fired because the man was Black.
She is charged with reckless conduct, criminal threatening, and attempted first-degree assault.
The state’s Civil Rights Unit alleges three violations of New Hampshire’s Civil Rights Act, seeking up to $5,000 per violation and a restraining order.
A trial is pending.
