The Irish Supreme Court ruled that wind farm developer Coolglass will receive 50% of its legal costs after a landmark decision affirming that climate change obligations are legally binding on all public bodies, including those without planning powers.
The court upheld a lower court’s reversal of a 2024 rejection of a 13-turbine wind farm in Timahoe, County Laois, on narrower grounds, stating climate duties are “real, effective, and enforceable.” While Coolglass succeeded on the central issue, the court found it did not prevail on most appeal grounds, justifying the partial cost award.
The case will return to An Bord Pleanála for reconsideration under the clarified legal standards.
