India’s Supreme Court has ordered WhatsApp to implement a consent-based data-sharing system by March 16, 2026, following criticism of its 2021 privacy policy as a violation of user choice.
The court called the policy a form of "theft of private information" and mandated that users can opt out of sharing data with Meta without losing access to the app.
The Competition Commission of India (CCI) had previously penalized Meta ₹213.14 crore and sought restrictions on data sharing for advertising, a ban later stayed by a tribunal.
While WhatsApp maintains end-to-end encryption protects messages and data sharing occurs only with user consent for optional features, the case remains before a five-judge bench, which may issue a five-year advertising ban.
