A New Mexico judge has dismissed a lawsuit challenging Republican gubernatorial candidate Duke Rodriguez’s eligibility, allowing him to stay on the June primary ballot.
The ruling, by Judge Matthew Wilson, found that rival James Ellison failed to meet a 10-day deadline for filing an expedited hearing, making the challenge legally insufficient.
Ellison, a former Public Regulation Commission member, argued Rodriguez lacks the required five years of continuous New Mexico residency, citing his Arizona voting history from 2002 to 2024 and registration in Scottsdale.
Rodriguez, who re-registered to vote in New Mexico in January 2025, maintains he meets residency requirements and that voters should decide the issue.
The state’s Secretary of State confirmed Rodriguez submitted proper documentation.
A separate lawsuit by Ellison remains pending.
