A former teacher jailed for defying a school ban over student pronouns seeks urgent appeal, citing new government guidance.
Enoch Burke, a former teacher jailed for over 600 days due to contempt of court, has sought an expedited appeal against a 2023 High Court ruling that barred him from Wilson’s Hospital School in County Westmeath.
The ban followed a dispute over a student’s preferred name and pronouns, which Burke, an evangelical Christian, said conflicted with his religious beliefs.
He argues a January Department of Education statement—asserting schools have no legal obligation to use preferred names or pronouns—now supports his appeal and justifies his continued incarceration.
Appearing via video-link before Judge Niamh Hyland, Burke requested a stay on the school’s disciplinary panel process, but the judge denied it, noting the Court of Appeal lacks jurisdiction until an extension of time to appeal is granted.
The court granted an April hearing despite reservations about the late filing, leaving the case unresolved.
