A judge ruled that an environmental group can get legal cost protection in challenging a Supermac’s wastewater connection in County Clare due to pollution risks.
A High Court judge has ruled that environmental group Friends of the Irish Environment (FIE) can receive legal costs protection in its challenge against a wastewater connection agreement for a Supermac’s service station in County Clare.
The decision, based on the Environment (Miscellaneous Provisions) Act 2011, follows FIE’s claim that connecting the Banner Plaza station to the already-overloaded Clareabbey wastewater plant risks worsening pollution in the River Fergus.
Though the station is operational, it remains unconnected.
The court found there is a “statable case” that the connection could cause environmental harm, supporting FIE’s right to cost protection.
The case involves Uisce Éireann, the Environmental Protection Agency, and the Attorney General as notice parties.
