A Irish court dismissed a mother’s negligence claim over her daughter’s delayed appendicitis diagnosis, ruling the GP acted appropriately despite the child’s severe complications.
A woman’s claim against a GP and out-of-hours service in Ireland over the delayed diagnosis of appendicitis in her 11-year-old daughter in December 2017 has been dismissed by the High Court.
Justice Leonie Reynolds ruled the GP’s diagnosis of gastroenteritis was reasonable, noting the doctor provided red flag advice and a referral letter despite the mother’s concerns.
The girl later required emergency surgery for a perforated appendix, suffered severe complications including infection and scarring, but the court found no clinical negligence, stating the GP met expected standards and the mother’s failure to act on the referral may have contributed to the delay.
The claim was dismissed, and the plaintiff was ordered to pay legal costs.
