Supreme Court rules Texas court can hear baby food lawsuit, sending case back to state court.
The U.S. Supreme Court unanimously ruled that a Texas state court properly has jurisdiction over a lawsuit filed by a Texas couple against Whole Foods and Hain Celestial Group over allegedly contaminated baby food.
The case, which claims the child suffered health issues due to heavy metals in Earth's Best Organic products, was improperly removed to federal court, the Court said, because all parties are from Texas, negating diversity jurisdiction.
The ruling, which does not address the merits of the claims, sends the case back to Texas state court for further proceedings.
The decision upholds a 5th Circuit ruling and affirms plaintiffs' right to choose their forum.
