The Pentagon is appealing a federal judge’s order blocking Defense Secretary Pete Hegseth from punishing Senator Mark Kelly, a former Navy pilot, over a November 2025 video in which Kelly and five other veteran lawmakers urged military personnel to resist unlawful orders from the Trump administration.
U.S. District Judge Richard Leon, appointed by George W. Bush, ruled in February 2026 that the punishment violated Kelly’s First Amendment rights and undermined veterans’ constitutional protections.
The Justice Department has requested a review by the D.C.
Circuit Court of Appeals.
Kelly called the appeal an attempt to suppress free speech, while Hegseth maintained the video constituted sedition.
The case remains pending.
