A New Zealand community garden seeks Supreme Court review to block development, citing a breached 2018 preservation agreement.
Sanctuary Mahi Whenua, a community garden in Auckland, has appealed to New Zealand’s Supreme Court to protect its 0.7-hectare site from development, arguing the Crown is violating a 2018 agreement requiring its preservation.
The appeal follows a December 2025 Court of Appeal decision that allowed development by dismissing the group’s legal claim and denying access to key documents needed to interpret the agreement.
The group says this denial risks a miscarriage of justice and is seeking Supreme Court review, with a decision expected in two to four months.
A caveat remains in place, and the group is raising funds for legal costs, having collected about $4,000, including $2,000 in fixed fees, with donations over $5 eligible for a tax credit.
