India's top court cleared 85-year-old VK Narayanan of criminal charges for displaying the flag upside down, citing lack of intent to disrespect.
The Bombay High Court quashed a 2017 criminal case against 85-year-old VK Narayanan, ruling that displaying the Indian flag upside down on his housing society’s terrace during Republic Day did not constitute a crime without proof of intent to disrespect the nation.
Justice Ashwin Bhobe emphasized that the Prevention of Insults to National Honour Act requires mens rea, which was absent, as there was no evidence Narayanan hoisted or intentionally inverted the flag.
The court noted his presence alone, along with an unconditional apology and advanced age, did not establish criminal liability.
The FIR and chargesheet were dismissed due to insufficient evidence.
