The Supreme Court on February 24, 2026, upheld Aadhaar’s use in India’s voter verification process, stating it remains valid under the Representation of the People Act 1950.
The bench, led by Chief Justice Surya Kant, told petitioner advocate Ashwini Upadhyay to seek legislative changes rather than judicial intervention, citing concerns over fake Aadhaar cards, especially in West Bengal.
The court emphasized that it cannot override laws passed by Parliament and reiterated its prior ruling requiring Aadhaar as a valid identity document during the Special Intensive Revision process.
It noted that all official documents can be forged and that enrollment agencies act under government authority.
The court declined to launch a probe into fraud allegations, saying such matters belong in the legislative domain.
