The University of Melbourne has lost its appeal against a ruling that reinstates former professor Stephan Matthai, who was fired in December 2024 for sending romantic messages to a PhD student in 2017.
The Fair Work Commission (FWC) upheld its original decision that while Matthai’s conduct— including private, flirtatious messages and sharing a photo in boxer shorts—breached workplace policies, the dismissal was harsh and unfair.
The FWC ordered his reinstatement and $28,098 in lost wages, citing the isolated nature of the misconduct and Matthai’s expressed regret.
The university argued the behavior was serious and involved a power imbalance, but the FWC’s full bench found the dismissal unreasonable.
The student reported discomfort in 2017, prompting a co-supervisor to be assigned, and she later switched advisors.
A formal complaint was made in 2024 after graduation, leading to an investigation of 141 messages.
