A UK High Court judge has overturned part of an international arbitration award requiring South Korea to pay U.S. hedge fund Elliott $107.8 million over a 2015 Samsung merger, clearing the way for a new review of the case.
The ruling, which dismissed claims tied to the National Pension Service’s role, follows South Korea’s challenge to the tribunal’s jurisdiction under the U.S.-South Korea Free Trade Agreement.
The decision, welcomed by Seoul as a "valuable victory," comes amid broader efforts to strengthen its legal defense in investor-state disputes, including plans to create an international legal bureau.
The case had previously been revived after the UK Court of Appeal ruled in South Korea’s favor in 2025.
