The Supreme Court has orally indicated that land acquisition cases before 2018 under the NHAI Act cannot be reopened to award interest on compensation to farmers, signaling a potential reversal of its 2019 ruling that had allowed retrospective benefits.
The observation came during a review hearing of a plea by the National Highway Authority of India, which argued the 2019 decision imposed a financial burden of about Rs 32,000 crore and should apply only prospectively.
The court rejected that argument, stating that prospective application would undermine the intent of ensuring equality under Article 14.
While finalized cases before 2018 will not be reopened for interest, pending claims from 2008 onward may still be considered for solatium.
The matter is adjourned for written submissions and further hearing in two weeks.
