Pennsylvania remains the largest state without a false claims act, despite bipartisan House support and Governor Shapiro’s backing, as the bill stalls in the Senate due to opposition from health care and business groups fearing frivolous lawsuits.
The proposed law, modeled after the federal False Claims Act, would allow whistleblowers to sue on the state’s behalf, recover funds from fraud—including in Medicaid and other state spending—and receive 10% to 30% of recoveries, while protecting them from retaliation.
States with such laws gain an additional 10% of federal recovery funds, a benefit Pennsylvania currently misses.
Advocates highlight that insiders report most fraud cases, and similar laws have recovered millions nationwide.
